Terms of Service

These terms of service apply to the use of the AI-based bid calculation and cost estimation service (hereinafter "Service") provided by Massoi (hereinafter "Service Provider").

The Service is designed for construction industry companies to automate quantity takeoff, cost estimation, and bid preparation.

By registering for or using the Service, you accept these terms.

Using the Service requires registration and creation of a user account. You are responsible for the safe keeping of your account credentials.

You agree to use the Service only for lawful purposes and in accordance with these terms. You may not use the Service in a way that could harm the Service, other users, or third parties.

The Service Provider has the right to remove a user account if the terms are violated.

Service prices are determined by the current price list. Prices are stated excluding value added tax, unless otherwise noted.

Billing occurs monthly in advance. Payment is charged from the payment method provided during registration.

The Service Provider has the right to change prices by notifying of the change at least 30 days before the new prices take effect.

Subscriptions can be cancelled at any time. Cancellation takes effect at the end of the current billing period.

The Service has no commitment period. After cancellation, access to the Service continues until the end of the billing period.

Paid fees are not refunded for the current billing period.

All intellectual property rights related to the Service, including software, user interface, and documentation, belong to the Service Provider.

The customer retains full rights to their own data, including drawings, calculations, and bids. The Service Provider does not acquire rights to customer data beyond the processing necessary to provide the service.

Customer data is never used for AI model training.

The Service Provider processes personal data in accordance with the privacy policy. The privacy policy is available at massoi.com/tietosuojaseloste.

A standard data processing agreement (DPA) is available for customers and can be read at massoi.com/dpa.

The Service is provided "as is". The Service Provider strives to ensure uninterrupted operation of the Service but does not guarantee uninterrupted availability.

The Service Provider is not liable for indirect damages, such as lost profits or business interruption.

The Service Provider's total liability is limited to the amount of service fees paid by the customer during the preceding 12 months.

The accuracy of AI-based calculations depends on the input material. The user is ultimately responsible for verifying the correctness of bids.

The Service Provider has the right to modify the Service and these terms. Significant changes will be notified at least 30 days before they take effect.

Continued use of the Service after changes constitutes acceptance of the changes.

These terms are governed by Finnish law.

Disputes arising from these terms shall primarily be resolved through negotiation. If negotiation is not possible, disputes shall be resolved in the Helsinki District Court.
